Spain's National Court dismisses the fraud case over Eco Beach City
Date of the order: 21 September 2026 · Preliminary proceedings 58/2025
On 21 September 2026, the Central Court of First Instance of Spain's Audiencia Nacional (Investigating Section, Court no. 1) ordered the provisional dismissal and archiving of preliminary proceedings 58/2025, opened over alleged fraud in connection with the Eco Beach City project and its founder, Carlos de Ory. It did so at the request of the Public Prosecutor, who on 2 September 2026 asked for the case to be archived because the commission of the offence had not been sufficiently proven.
What the investigation found, according to the court order
- The police report of 21 August 2026 shows the existence of real investment activity and the material execution, at least in part, of the announced project.
- Payments of more than €2 million were identified for the purchase of land through Indonesian notaries, as well as payments to architecture and urban development firms, builders, consultants, furniture and equipment, and advertising.
- The bank analysis by UDEF (the Spanish police's economic and tax crime unit) shows movements consistent with carrying out and developing the project, and repayments to investors of more than €3 million.
- Spain's Interior Attaché in Indonesia checked the site in person and found twenty glampings, four completed villas, auxiliary infrastructure and staff at work, matching what the project's website shows.
- The judge concludes that differences between some investors' expectations and the project's actual progress do not, on their own, establish any deception, and that the shortfall, delay or business failure of an investment project is not necessarily a crime.
What a "provisional dismissal" means
The case is closed and archived because, after the investigation by the police, UDEF and Spain's Interior Attaché in Indonesia, no offence was proven.
It is called provisional because, like any dismissal under article 641.1 of Spain's Criminal Procedure Act, it could only be reopened if new evidence appeared.
As far as we know, no one has appealed the order.
